Summit Path 1 is a trading name operated by Volker H. H. Glaeske.
In these Terms, “Operator” refers to Volker H. H. Glaeske.

1. Nature of Services

Summit Path 1 provides executive coaching, leadership mentoring, career strategy advisory, and related professional development services.

These services are intended solely for informational, developmental, and educational purposes. They do not constitute legal, financial, investment, tax, medical, psychological, therapeutic, employment, or other regulated professional advice.

Summit Path 1 does not provide management consulting, financial advisory, legal advisory, or regulated professional services. No fiduciary, agency, employment, partnership, or professional-client relationship is created.

Clients remain solely responsible for their own decisions, actions, applications, communications, and outcomes.

2. No Warranty or Guarantee of Results

All services are provided on a best-effort basis.

Summit Path 1 and the Operator make no representations, warranties, or guarantees — express or implied - regarding any specific outcomes, including but not limited to:

• promotions

• salary increases

• bonuses or equity grants

• job offers

• career progression

• performance reviews

All outcomes depend solely on the Client’s own decisions, actions, and circumstances.
 

3. Client Responsibility

The Client acknowledges and agrees that:

• they are solely responsible for all decisions, actions, and results arising from or related to the services

• they will exercise independent judgment when applying any guidance, insight, or recommendation

• participation is voluntary and at their own risk

Summit Path 1 and the Operator shall not be responsible or liable for any decision, action, or omission by the Client.
 

3A. No Reliance

The Client confirms that they have not relied on any representations, statements, or promises not expressly set out in these Terms.
 

4. Limitation of Liability

To the fullest extent permitted by law, Summit Path 1 and the Operator shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

• loss of profits, income, or employment

• loss of business opportunities

• loss of goodwill or reputation

• loss of anticipated savings or data

This applies whether in contract, tort (including negligence), or otherwise, whether foreseeable or not.

In no event shall the total aggregate liability of Summit Path 1 and the Operator exceed the total fees paid by the Client in the twelve (12) months immediately preceding the claim.
 

5. Indemnification

The Client agrees to indemnify, defend, and hold harmless Summit Path 1 and the Operator from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• the Client’s actions, decisions, or professional conduct

• any misuse or misapplication of guidance provided

• any third-party claims connected to the Client’s activities

6. Fees, Payments & No Refund Policy

All fees are payable in advance.

All payments are final and non-refundable to the fullest extent permitted by law, including in cases of partial use, dissatisfaction, changes in circumstances, or termination of services by either party.
 

7. Cancellation & Rescheduling

• Sessions may be rescheduled with at least 8 hours’ prior notice (Hong Kong time)

• Late cancellations, rescheduling requests within 8 hours, or no-shows will be charged in full

• Summit Path 1 reserves the right to reschedule or cancel sessions if necessary, in which case a full credit or alternative time will be offered
   

8. Confidentiality

All communications and information shared during sessions are treated as strictly confidential.

Information will not be disclosed to third parties without the Client’s explicit written consent, except where required by law, court order, or regulatory authority.

Summit Path 1 may use fully anonymised and aggregated insights for internal service improvement purposes only.
 

9. Use of Tools

Summit Path 1 may reference frameworks, tools, or technologies (including AI-based tools) for preparation purposes.

Such tools are supplementary and do not replace the Client’s independent judgment or real-world decision-making.
 

10. No Employment or Partnership

Nothing in these Terms or the services creates an employment relationship, agency, partnership, joint venture, or fiduciary duty.

The Client remains fully independent and solely responsible for all professional obligations, taxes, insurance, and compliance.
 

11. Online Booking & Acceptance of Terms

By booking a session, purchasing any service, or accessing the website, the Client confirms that they:

• have read these Terms

• understand them

• agree to them fully

This constitutes a legally binding agreement. No physical or electronic signature is required.

12. Force Majeure

Neither party shall be liable for any delay or failure to perform due to causes beyond its reasonable control, including but not limited to:

• natural disasters

• pandemics

• government restrictions

• war or terrorism

• strikes or illness

• technical failures outside reasonable control

13. Dispute Resolution & Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through good-faith discussion.

If unresolved within 30 days, the dispute shall be referred to final and binding arbitration in Hong Kong under the HKIAC Administered Arbitration Rules, which are deemed to be incorporated by reference.

• Number of arbitrators: One

The parties waive any right to court litigation, jury trial, or class actions.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between the parties and supersede all prior or contemporaneous understandings, representations, or agreements, whether oral or written.

17. Amendments

Summit Path 1 may update these Terms at any time.

Continued use of services after any changes constitutes acceptance of the updated Terms.
